【入住必须签署转租合同】

如果是入住学生公寓,一定要与公寓签订相应的转租合同。英国学生公寓都是不允许学生做二房东转租的,必须通过前台合法转租。一旦发现没有签订转租合同就入住的情况,租客如果没有在原始记录的合同里面,会要求立即马上搬离学生公寓,钥匙也会被扣留,并且押金不退。

You may cancel within seven days of signing your agreement online. You have the right to the return of your deposit and any rental amounts paid in relation to your booking.


You will lose your right to cancellation as soon as you collect the keys from the reception team even if this is within seven days of signing your agreement.


First year students and first-time residents

If you are a first year student or you are residing in the Building for the first time, you may request to cancel and have any deposit and rental amounts which relate to your booking returned to you if:


You do not receive an unconditional offer from your University. You may request to cancel up to seven days following the release of A Level Results by providing your cancellation request in writing along with supporting evidence that the required results have not been achieved for you to take up your course.


You require a visa to study in the UK, but your visa application has been rejected. You may request to cancel up to seven days after rejection of your visa application and no later than seven days following the release of A-Level results by providing your cancelation request in writing along with supporting evidence that your Visa application has not been successful.


Ongoing students and returning residents

We reserve the right to cancel your booking and resell your room if you fail to collect your key within 14 calendar days of the booking start date. You remain liable for all amounts due under the agreement until the room is sold and for any lost rental amounts between bookings which we may deduct from any deposit we hold.


If the first rent instalment is due prior to the booking start date and it is not received as cleared funds within seven days of the due date, we reserve the right to cancel your booking and resell the room. You remain liable for all amounts due under the agreement until the room is sold and for any lost rental amounts between bookings which we may deduct from any deposit we hold.


If after the start date of your booking you would like to be released from the agreement and a replacement resident is found by you who we believe to be eligible in our absolute discretion, we will release you from the agreement, from the date the new agreement with the new resident takes effect. Your deposit will then be refunded and we will charge a fee amount equal to our costs of preparing your room for the new occupant. You will remain responsible for any rental arrears outstanding on the date the agreement ends.


If, after the commencement of your booking, you would like to be released from the agreement but you have not found a replacement resident (as described above) to take over the agreement then we reserve the right to retain the deposit and you will remain liable for the full rent and other charges detailed in your agreement until the booking ends.

We hate to see you cancel your booking but we understand that factors may arise that lead to you having to cancel.


Cancellation policy (An ‘Academic year’ covers the period 1st September to 31st August)


For bookings made between 1st October – 31st July for the forthcoming academic year commencing 1st September, you can cancel your booking in writing or by sending us an email within the 48 hours ‘cooling off period’ of accepting and completing your tenancy online.


For bookings made after 1st August for the forthcoming academic year, there is no cooling off period and you cannot cancel your booking. (please see our re-letting policy)


For bookings made during and for the current academic year (from 1st September to 31st August), you cannot cancel your booking once you have accepted the tenancy offer (either manually or digitally online)

Please note that once you have received your key and checked in to your accommodation you cannot cancel your booking and you will be legally bound by the terms and conditions of the accepted Tenancy Agreement and will be liable to pay all the amounts due.


If you do need to cancel you will need to follow our re-letting policy or meet the requirements of our No place, No Pay policy.


In instances where a holding deposit has been paid and the tenant fails to manually or digitally complete the booking, or declines the tenancy offer, we reserve the right to retain the holding deposit in lieu of costs incurred.


Once you have booked and completed your tenancy agreement, you will be legally bound by the terms stipulated in the agreement.


After cooling-off period has expired

If the 48-hour cooling-off period has expired there are some scenarios where you may be able to cancel your booking if you meet the necessary requirements. These are:


  • No Place, No Pay Policy

If your offer of a place at your preferred/current University/Higher Education Institution is withdrawn by the University/Higher Education Institution as a result of you not achieving their required entry grades or passing your end of year exams, you may be eligible to be released from the tenancy agreement.


You may also be eligible to be released from this agreement if you are a prospective first year undergraduate student and you choose to go to a University in a different city because you have exceeded your expected grades.


To apply to be released from this agreement in the circumstances referred to above, you will need to supply us with a copy of:


  • a written rejection letter from your chosen university /college or UCAS or a screen shot of your UCAS status which confirms that the required results were not achieved; or

  • a copy of the proof of acceptance of your new university by UCAS adjustment.

These document(s) must be received by us within 7 calendar days from the date your results are published or by 1st September (which ever date is the sooner). Please email the documentation to info@downingstudents.com. On receipt of the required documentation, it will be verified and, provided we are satisfied, we will cancel your agreement and refund your holding deposit in full


  • No Visa

If you cannot get a visa to study at a UK University (either on campus or online remote study) and you can provide written evidence that your visa and university application has been refused, we will release you from your tenancy agreement and make a full refund.


Evidence must be provided within one week of notifying us that you are unable to obtain a visa.


If the Tenancy has already commenced, and you have NOT collected your keys, you will be charged for the period from the ‘Tenancy Start Date’ to the date you provide the evidence that you have not been granted a VISA and/or do not have a place at a UK University.


If the tenancy has started and / or you have moved into the accommodation prior to your Visa application being declined you will be responsible for the rent until we can find another tenant to rent your room  (please see our Re-letting policy)

If for any reason you decide to leave during your contracted term, we might be able to release you from your tenancy agreement. But only if these conditions are met:


You agree not to transfer or sublet the tenancy to anyone else without our written consent, as in point 7.1(n) of the tenancy agreement.

You find a suitable replacement to take a new tenancy agreement for the rest of your tenancy. This person must: be at least 18 years old and enrolled as a full-time student in a university close to the accommodation; enter into a tenancy agreement with us and pay all sums due within it; and provide a guarantor where reasonable, who must accept the terms and conditions set out in the tenancy agreement.

You pay a £50 administration fee.


We can't refund you until the student replacing you has taken over your room's contract, signed the tenancy agreement, paid, and moved in.


If you can't find someone to take over your tenancy, you'll be responsible for paying the full rent until the end of your tenancy agreement.

Our full termination policy is detailed for you within the booking section of our website. Please read it carefully and ensure that you fully understand it.

You can cancel your booking up to 14 days after you accept your offer or pay your deposit (the Initial Cancellation Period), which reduces to 7 days from 1st August ahead of the academic year being booked, providing you have not already moved in to the property and we will refund your security deposit in full. Deposits will normally be refunded within 28 working days of cancellation, however our legal obligation as a landlord is to secure all deposits with a third party protection scheme. In the event that your deposit has already been sent to the protection scheme by the time you cancel your booking, your refund could take up to 60 days to be refunded due to the protection scheme's processing period and your deposit refund will come directly from them – you will need your repayment ID which will be sent to you directly by the protection scheme. If the deposit has already been sent to the deposit protection scheme, unfortunately, we are unable to influence their processing time.

If you cancel your booking after the 14 day Initial Cancellation Period (7 days after 1st August), you will remain liable for the weekly rent (for each and every week or part week) until we are able to re-let the room. If we are able to re-let the room we will release you from the agreement upon payment of a £50 variation of contract fee which we will recover by retaining part or all of your deposit. If you have paid a lower deposit amount, that's the amount that will be retained.


HFS's standard cancellation policy does not apply to Republic of Ireland. 


Aspen's cancellation policy as per the Licence to Reside:


7. Cancellation Policy

Cancellation Prior to Commencement of Licence Agreement:
If the booking is cancelled within 24 hours of signing the licence the Licensor agrees not to hold you liable for the full term of your contract, however the Deposit will not be refunded.


Cancellation after confirmation.
Where the Licence is cancelled or revoked after payment is receipted all monies will be forfeited.

If you have entered into the Tenancy Agreement and you wish to cancel your booking, you will remain liable for the contractual obligations set out in the Tenancy Agreement and you may not cancel the booking unless you can provide proof that you fit any of the following criteria and have not yet collected your key, and provide the evidence required within the timescales as detailed below:


You notify us of your intention to cancel your booking prior to 1 August or, if your Tenancy Start Date (as defined in your Tenancy Agreement) is in any month other than September, 28 days before your Tenancy Start Date.


You notify us of your intention to cancel within 7 days of payment of your Booking Fee (if you have paid a Booking Fee) and you have not collected your keys.


  • Your UK Visa application has been denied.

  • You have not obtained the required qualifications to get into your first University of choice

  • You are deferring your university entry.


Where the reason for cancellation can't be proved with supporting evidence attached to the cancellation request in line with the above, the student will remain liable for the full contractual rent, unless and until a replacement tenant is found. The student is responsible for finding an eligible replacement tenant, although site staff will assist where possible.

If a replacement tenant is found, once the new replacement tenant has signed their Tenancy Agreement and paid any rent due, the student will be released from the contractual obligations laid out in the Tenancy Agreement. Any overpaid rent money will be refunded, less an amount equal to your Booking Fee (if you have paid a Booking Fee), as a cancellation fee.

Between the dates of 1st November to 30th June, there is a cooling off period of seven (7) days after the Initial Payment has been made and a Booking Confirmation has been received. Between the dates of 1st July to 31st October, there is a cooling off period of forty eight (48) hours after the Initial Payment has been made and a Booking Confirmation has been received. After this deadline you may cancel your booking up to and including 10th September 2023 by sending an email to bookings.uk@scape.com. In this instance you will forfeit your Initial Payment.


Past this, you are responsible for finding a suitable replacement (a student not already living at the property, who is attending a full time course). Until a suitable replacement is found you are liable for the rent owed, and once you've found a replacement you will have make a £350 payment relating to the room clean and transfer of the lease. We refer students looking for rooms outside of our normal booking periods to this Facebook group.

CANCELLATION POLICY RELATING TO BOOKINGS FOR ACADEMIC YEAR 2023/24

A. During cooling-off period

You can cancel your booking in writing or by sending an email directly to the Property Team within 7 days of accepting your tenancy agreement. If you decide to cancel your accommodation booking within these 7 days, we'll arrange a full refund of your deposit. No fees, no fuss.

If you book your accommodation on or after 1 August 2023, your cooling off period will reduce to 24 hours only from the point you accept it. If you do cancel your booking within these 24 hours, we will arrange the return of your full deposit.

Please note that at the point you receive your key and check in to your accommodation, the cooling-off period will immediately and automatically end.

B. After cooling-off period has expired

If you wish to terminate your tenancy agreement after the cooling-off period has expired, there are some circumstances where you may be able to be released from your tenancy, e.g. if you can evidence that you are not/are no longer a student at university. In other cases, you may need to find a replacement tenant.

Please read the sections below, and check if any of these apply to you. To put in a cancellation request, please send an email or letter directly to your Property Team. They will respond as soon as possible, letting you know if there is any extra information you need to provide.

The following procedure applies to the below:
• Failure to receive grades (all academic years)
• Failure to obtain visa (all academic years)
• Studying in an alternative city where Student Roost accommodation is unavailable
• The pre-sessional English language course required to take up your University place is cancelled
• Deferment of University entry (all academic years)
• Eviction from University
• Voluntary withdrawal from University

If you've confirmed your Student Roost accommodation but then can longer attend the affiliated University for one or more of the above reasons, you may be able to cancel. If this has happened to you, please email or write to your Property Team immediately, explaining the reason(s) you need to cancel. You must also provide official written evidence from the relevant University and/or Summer School and/or UCAS and/or VISA authorities/embassy (which must include the reason(s) why you cannot attend the relevant University) to your Property Team within 3 calendar days of the results or decision being published or reached. If sufficient evidence is provided to our satisfaction, you will be eligible for release from the tenancy agreement and we will arrange to return your full deposit (if you have already moved into your accommodation, this would be minus any deductions relating to rent owed for the period you have occupied the Accommodation, the condition of your room/flat upon your departure).

If you have changed your mind about your choice of University and wish to study in a different city, we will seek to place you in Student Roost accommodation in that city, if such accommodation is available. If alternative Student Roost accommodation is unavailable, and you provide sufficient evidence of your change in circumstances as set out above, you will be eligible for release from the tenancy agreement and we will arrange the return of the full deposit (minus any deductions that apply if you have moved in).

The following procedure applies to the below:
• Change of mind
• Booked different accommodation
• Accepted onto a placement
• Single semester course
• Classes temporarily or permanently being delivered online, or decision to commute to your University city


If you do not wish to live at Student Roost for one or more of the above reasons, you will be required to find a replacement person to take over your tenancy. The replacement person must be a student and match the preferences of the accommodation (e.g. female-only flat).

The replacement person must sign a contract for the entire length of your tenancy agreement and secure this with payment of the deposit. If a replacement person is found, you will be released from your tenancy agreement from the start date of the replacement person’s tenancy. Student Roost will also return your deposit in full (minus any deductions relating to the condition of your room/flat upon your departure). Please note that your deposit will be retained and you will remain liable for all accommodation fees until a replacement person is found and their tenancy starts.

We assess all requests to cancel on a case-by-case basis. You, or someone who you have given written authority to act on your behalf, must make a request to cancel in writing or via email to the Property Team. You must also provide sufficient documentation supporting the reasons for the request and why they prevent you from living in your accommodation.

Until a decision has been made, you will remain liable for all accommodation fees. If a tenancy release is not granted, you will be required to find a replacement person before you are released from your tenancy. If you are granted a tenancy release, we will arrange the return of your deposit (minus any deductions relating to the condition of your room/flat upon your departure).

How to cancel your booking

Unless you have already collected the keys to the accommodation, you may cancel your booking by writing or sending an e-mail to us at cancellations@unitestudents.com, at any time during the 7 days after we send you an e-mail confirming your booking is complete (the “7 Day Cooling-Off Period”). If you do that, you will not be charged and we will return your deposit or any Advance Rent Payments you have made.


Provided the 7 Day Cooling-Off-Period has expired, you will have to pay all amounts due under your Tenancy Agreement unless a replacement Tenant is found for your Room or you enter into a new Tenancy. If a replacement Tenant is found for your Room before your start date, we will release you from your Tenancy Agreement on the date seven days after the new Tenant's Tenancy Agreement is signed. If a replacement Tenant is found for your Room after your start date, we will release you from your Tenancy Agreement from the start date of the replacement Tenant's new Tenancy Agreement. If you have occupied the Room prior to this, you will be charged £50.00 to cover our costs of preparing the Room for the replacement Tenant.

No Place No Pay – applicable to 1st year students only. If you are a prospective first year undergraduate student and your offer of a place at your preferred University/Higher Education Institution is withdrawn by the University/Higher Education Institution as a result of you not achieving their required entry grades, you may be eligible to be released from this agreement. You may also be eligible to be released from this agreement if you are a prospective first year undergraduate student and you choose to go to a different University because you have exceeded your expected grades. To apply to be released from this agreement in the circumstances referred to above, you will need to supply us with a copy of:


  • a written rejection letter from your chosen university/college or UCAS or a screen shot of your UCAS status which confirms that the required results were not achieved; or

  • a copy of the proof of acceptance of your new university by UCAS adjustment.

CANCELLING YOUR BOOKING

Your right to cancel: Please note the rights set out below do NOT apply to Clearing Rooms which may be offered directly to certain students to book for a limited time under certain circumstances at specific times of the year. We do not list, advertise or promote Clearing Rooms, which have more restricted cancellation rights, on the vitastudent.com website.


Any Clearing Rooms are clearly identified as such in the accompanying communication sent to students who receive an invitation to book them, and are subject to the special terms in the Accommodation Agreement (or similar accommodation contract) which relate to them.
PLEASE CAREFULLY READ THESE SPECIAL TERMS BEFORE BOOKING A ‘CLEARING ROOM’ AS THE NORMAL CANCELLATION RIGHTS EXPLAINED BELOW MAY NOT APPLY.

You may cancel your booking (and the Accommodation Agreement to which it relates) without charge by giving notice no later than five (5) days after the day on which we dispatch the Confirmation Documents to you, provided such notice is given in writing prior to 28th May in the year of commencement of the start of the occupation period. If you cancel your booking within this period we will refund the full amount of the Advance Payment to you within twenty eight (28) days of our receipt of your cancellation notice to the payment card you used to make the booking.


You may only cancel your booking (and the Accommodation Agreement to which it relates) without charge after 28th May in the year of commencement of the Occupation Period if notice of cancellation is provided to us in writing within a period of forty eight (48) hours starting from the day we dispatch the Confirmation Documents to you. 

If you cancel your booking within this period we will refund the full amount of the Advance Payment to you within twenty eight (28) days of our receipt of your cancellation notice to the payment card you used to make the booking.


The rights set out in clause 6.3 only apply PROVIDED THAT:
For the avoidance of doubt, cancellation notices cannot be accepted where none of the circumstances set out in clause 6.3 above apply yet you choose not to occupy your Accommodation for whatever reason.

in the case of being declined a visa to study in the UK, submit the cancellation request no later than 16th August 2023;


in the case of being declined a place at university (but not if you choose to withdraw from your place), you provide us with evidence (to our reasonable satisfaction) at the time of submitting the cancellation notice; and


you notify Us in writing within 48 hours of becoming aware of the reason for the cancellation and;


you have not already commenced occupation of the Accommodation at the time any of the circumstances may apply.


Where clauses 6.1, 6.2 and/or 6.3 above have not been satisfied you may only cancel your booking in accordance with the terms of the Accommodation Agreement.


In all cases, we will determine whether there are grounds for cancellation and our decision will be final and binding.


Where clauses 6.1, 6.2 and 6.3 above do not apply, we give no guarantee or warranty of any assistance in advertising or marketing your Accommodation should you, for whatever reason, no longer wish to occupy the Accommodation. Any other accommodation in our residences which are at the time not booked will take priority over your Accommodation and we will not openly advertise your Accommodation on our Site until all other accommodation is booked. Any offer of assistance in advertising your Accommodation, either verbally or in writing is subject to this clause and limited to us retaining details of your Accommodation, answering specific questions about your Accommodation when asked, and the administration of the agreement with the replacement licensee, if applicable. Where any further steps are taken by us, this is done at our absolute discretion and does not impose any duty or obligation on us other than as explicitly set out in these Terms.


Any notice given under clauses 6.1 and/or 6.2 and/or 6.3 above must be in writing and sent either by email to hello@vitastudent.com or by post using the address provided under paragraph 14 (Contact Us) below.

Cancellation Policy - England & Wales 2023/24

Unless the context otherwise requires, words and expressions defined in your Assured Shorthold Tenancy Agreement shall have the same meanings in this cancellation policy.


Bookings made prior to 1st May 2023

If you sign your tenancy agreement prior to 1st May 2023 and you have not collected the keys to your room, you may cancel your tenancy, by giving notice in writing or by e-mail to the manager at the property, with no penalty up until 1st May 2023. Once we receive such a notice, we will confirm receipt, cancel your tenancy agreement and will refund your advance rent payment of £250.00, together with any other payments of rent you may have made.


Bookings made on or after 1st May 2023

If you sign your tenancy agreement on or after 1st May 2023, unless the tenancy agreement has already commenced and you have not collected the keys to your room, you may cancel your tenancy, by giving notice in writing or by e-mail to the manager at the property, at any time within the period of fourteen (14) days of the date on which you sign your tenancy agreement (the “Cooling-Off Period”). Once we receive such a notice, we will confirm receipt, cancel your tenancy, and will refund your Advance Rent Payment of £250.00, together with any other payments of rent you may have made.


Bookings made for Semester 2 or 3 starting after the 1 January 2023

If you sign a tenancy agreement for a semester booking you may cancel your tenancy, by giving notice in writing or by e-mail to the manager at the property, with no penalty up until 8 weeks before the start of your agreement. Once we receive such a notice, we will confirm receipt, cancel your tenancy, and will refund your advance rent payment of £250.00, together with any other payment of rent you may have made.


Unless the tenancy agreement has already commenced and if you have not collected your key, you may also cancel at any time within the period of fourteen (14) days of the date on which you sign your tenancy agreement (the "Cooling-off Period"). During the cancellation period you may cancel your tenancy, by giving notice in writing or by e-mail to the manager at the property. Once we receive such a notice, we will confirm receipt, cancel your tenancy, and will refund your advance rent payment of £250.00, together with any other payment of rent you may have made.


Cancelling outside the Cooling-Off Period

Outside the cooling-off period, you may request to cancel your tenancy, by notice in writing or by e-mail to the manager at the property. However, you will remain liable for the rent payable under the tenancy agreement until a suitable replacement tenant has been found

.

Cancelling as you do not receive your visa

If you are not successfully awarded a visa to travel and study, then we can help. Firstly, we may be able to transfer you to another one of our residences around the globe if you are going to study elsewhere. If you are not going to study elsewhere or we do not have accommodation available in your new city/town of study, we will release you from your tenancy agreement provided the following criteria are met:


You submit your request to cancel, in writing or by e-mail to the manager at the property, within 3 days of your visa rejection letter: and

You provide the manager with a copy of your rejection letter from the embassy or visa office.


If your tenancy has commenced, you will remain liable for the rent payable under the tenancy agreement until receipt of the above.

One less worry if you don't receive your offer


This is applicable to prospective first-year undergraduate students only

If you are not successful in obtaining your place at your chosen university, then don’t worry, we can help. Firstly, we may be able to transfer you to another one of our residences if you are going to study elsewhere. If you are not going to study elsewhere or we do not have accommodation available in your new city/town of study, we will release you from your tenancy agreement provided the following criteria are met:


You submit your request to cancel, in writing or by e-mail to the manager at the property, before 22nd August 2023; and


You provide the manager with a copy of your rejection letter from the University or UCAS.


 Once we have your request, we will confirm receipt and refund your advance rent payment of £250.00, together with any other rent payments you may have made.


CANCELLATION POLICY - Scotland 2023/24

Unless the context otherwise requires, words and expressions defined in your tenancy agreement shall have the same meanings in this cancellation policy.

If you sign a Tenancy Agreement for a semester beginning after the 1st January 2024, you may cancel your Tenancy, by giving notice in writing or by e-mail to the manager at the Property, with no penalty up 8 weeks before the start of your agreement. Once we receive such a notice, we will confirm receipt, cancel your Tenancy and will refund your Advance Rent Payment of £250.00, together with any other payments of Rent you may have made.


Unless the Tenancy Agreement has already commenced and if you have not collected your key you may also cancel at any time within the period of fourteen (14) days of the date on which you sign your Tenancy Agreement (the “Cooling-Off Period”). During the cancellation period you may cancel your Tenancy, by giving notice in writing or by e-mail to the manager at the Property. Once we receive such a notice, we will confirm receipt, cancel your Tenancy and will refund your Advance Rent Payment of £250.00, together with any other payments of Rent you may have made.


Cancelling outside the Cooling-Off Period

Outside the cooling-off period, you may request to cancel your tenancy, by notice in writing or by e-mail to the manager at the property. However, you will remain liable for the rent payable under the tenancy agreement until a suitable replacement tenant has been found.

Cancelling as you do not receive your visa


If you are not successfully awarded a visa to travel and study, then we can help. Firstly, we may be able to transfer you to another one of our residences around the globe if you are going to study elsewhere. If you are not going to study elsewhere or we do not have accommodation available in your new city/town of study, we will release you from your Tenancy Agreement provided the following criteria are met:


You submit your request to cancel, in writing or by e-mail to the Residence Manager at the Property, within 3 days of your visa rejection letter; and


You provide the Residence Manager with a copy of your rejection letter from the embassy or visa office.


If your tenancy has commenced you will remain liable for the rent payable under the tenancy agreement until we receipt of the above.

One less worry if you don't receive your offer


This is applicable to prospective first-year undergraduate students only

If you are not successful in obtaining your place at your chosen university, then don't worry, we can help. Firstly, we may be able to transfer you to another one of our residences if you are going to study elsewhere. If you are not going to study elsewhere or we do not have accommodation available in your new city/town of study, we will release you from your tenancy agreement provided the following criteria are met:


You submit your request to cancel, in writing or by e-mail to the residence manager at the property, before 15th August 2023; and


You provide the manager with a copy of your rejection letter from the University or UCAS.


Once we have your request, we will confirm receipt and refund your Advance Rent Payment of £250.00, together with any other rent payments you may have made.
