近日,陕西“潼关肉夹馍”与河南“逍遥镇胡辣汤”商标维权事件引发关注。
据报道,陕西潼关肉夹馍小吃协会以侵害商标权为由,对全国多家招牌中带有“潼关肉夹馍”字样的小吃店发起诉讼,要求商户撤销相关字样并赔偿相应费用,如想继续使用该商标,需缴纳加盟费。“逍遥镇胡辣汤”也有类似的案例。
China's intellectual property watchdog on Thursday rejected infringement of trademark rights claims from two Chinese street food associations.
Xiaoyaozhen hulatang (pepper hot soup) association in central China's Henan province and Tongguan roujiamo (meat burger) association in Northwest China's Shaanxi province filed law suits over trademark infringement by street vendors who used the names "Xiaoyaozhen" and "Tongguan" in their names.
The two associations have demanded the vendors to pay a membership fee every year or pay compensation.
11月26日,国家知识产权局对此回应:“逍遥镇”作为普通商标,其注册人并不能据此收取所谓的“会费”。“潼关肉夹馍”是作为集体商标注册的地理标志,其注册人无权向潼关特定区域外的商户许可使用该地理标志集体商标并收取加盟费。同时,也无权禁止潼关特定区域内的商家正当使用该地理标志集体商标中的地名。
国家知识产权局指出,既要依法保护知识产权,又要防止知识产权滥用,处理好商标权利人、市场主体和社会公众之间的利益关系。
China National Intellectual Property Administration said the two associations have no right to impose franchise fees on street venders for using the name in their brand name.
The registrant of Xiaoyaozhen cannot charge a so-called membership fee as it is registered as an ordinary trademark, according to the China National Intellectual Property Administration.
Tongguan meat burger is a geographical indication registered as a collective trademark, and its registrant has no right to license the collective trademark to merchants and charge franchise fees, it said.
11月26日下午,潼关肉夹馍协会公开发布《给全国潼关肉夹馍经营者的一封致歉信》。该协会在致歉信中表示:立即停止对全国潼关肉夹馍经营者的维权行为。
信中还写道:“此前,我们潼关肉夹馍协会对潼关肉夹馍商标进行维权一事,给广大肉夹馍经营者带来了严重的困扰和麻烦。经过全国众多媒体朋友和专家学者的批评、指正和帮助,我们认识到了自身存在的错误,就是把协会‘不忘初心、全心全意为潼关肉夹馍经营者服务’的宗旨丢掉了,我们深感自责,在此,诚恳向大家深深致歉!”
肉夹馍用英文怎么说?

有国外网友吃过潼关肉夹馍后疯狂种草,直呼真香(Yummy)。
国外媒体也经常把肉夹馍称为meat burger, meat sandwich或是Chinese hamburger。

The roujiamo originated in the Shaanxi province of China, and is now eaten all over the country. It's typically prepared and eaten on the street. The dough for the bun, or mo, consists of a simple mixture of wheat flour, water and maybe yeast. Of course recipes may vary, but this basic equation makes for a chewy and subtle pillow for the delicious filling. While the mo is traditionally baked in a clay oven, today it's often fried in a pan. 所以,肉夹馍的英文其实就是“Roujiamo”。
